ملخص:

يمكن لإدارة الجمارك أن تتصـالح مع مرتكبي الجرائم الجمركية . وقد تتم المصالحة الجمركية قبل صدور حكم نهـائي وقد تجري المصالحة بعد صدر الحكم القضائي غير أنه لا يمكن التصالح مع الإدارة بعد أن يصبح الحكم نهائيا.
وبسبب أهمية المصالحة الجمركية كأداة فعالة ومهمة لتسوية المخالفات الجمركية فإنه لا بد من إعادة النظر في التصور الحالي للمصالحة ، و ذلك بجعل المصالحة الجمركية هي الطريق الأول لتسوية ملفات المنازعات الجمركية بدلا من كونه الإستثناء ، وهو ما يفرض ضرورة وجود نصوص وقواعد قانونية واضحة ومحددة بهذا الخصوص .
